Terms of use and sale

Last updated: 23 October 2026 · This translation is provided for information: in case of any discrepancy, the French text prevails.

These terms apply to the use of Pointly, the time tracking app available at app.pointly.be, by client companies and the people they invite. Pointly is reserved for professionals.

In brief

1. Who we are, and who is concerned

Pointly is a service published by Matias Arbesu, a natural person (project being set up), whose details appear in the legal notice (“Pointly”, “we”).

The client is the company or self-employed person who creates an account in Pointly. Its users are the people it invites: its employees and, where applicable, other administrators. By creating its account, the client accepts these terms; by activating their account, each user undertakes to comply with them.

2. The service

Pointly lets employees record their working hours (timer or manual entry, site, breaks, notes, photos), including offline, and lets the client approve them, consult them and export summaries.

We develop the service to improve it. We may interrupt it briefly for maintenance, keeping disruption to a minimum. We strive to keep it available at all times, without being able to guarantee that there will never be an interruption.

3. Account and access

4. Plans and prices

Pilot programme

Pointly selects 5 pilot companies, on application. For them, use is free for 6 months, with the full Team plan and whatever the number of employees: nothing is charged during this period. Its end date is shown in the client's account, on the Subscription page.

We set Pointly up with the client's team, at their premises or remotely. In return, the client uses Pointly with its team and takes part in three follow-up meetings with us: after two weeks, at three months and before the end of the free period. If it wishes, it may give us a testimonial, which we only publish with its written consent.

At the end of the free period, the client freely chooses whether to continue. If it continues, it receives a 30% discount on the rate above (i.e. €3.50 per employee instead of €5), for life, as long as its subscription is not cancelled. The payment terms of article 6 then apply.

5. 30-day free trial

A bank card is requested before the first employee is invited. Registering it opens a 30-day trial period during which nothing is charged. At the end of the trial, the subscription continues automatically unless the client has cancelled it beforehand. The trial is granted only once per client.

6. Payment

7. Duration and cancellation

8. Your employees' data

For the data that the client records about its employees (time entries, photos, contract hours), the client is the controller and we are its processor within the meaning of article 28 of the GDPR. As such, we undertake to:

The client informs its employees of the use of Pointly and makes sure it is entitled to process their data.

9. Use of the service

The client and its users undertake to use Pointly lawfully, not to attempt to access other clients' data, and not to disrupt the service. Pointly is a time recording tool: the client remains responsible for complying with its legal and social obligations, and Pointly does not constitute legal advice.

10. Liability

We provide the service with care. Our liability is limited to direct damage and, except in the case of gross or intentional misconduct, to the amount paid by the client in the 12 months preceding the event giving rise to it. We are not liable for indirect damage, such as loss of turnover.

11. Intellectual property

Pointly, its code, its name and its logo remain our property. For the duration of the subscription, the client receives a right to use the service for the needs of its business. The client remains the owner of its data.

12. Changes to the terms

We may change these terms. In the event of a significant change, the client is notified by email at least 30 days in advance; if it does not accept them, it may cancel its subscription before they come into force.

13. Applicable law and disputes

These terms are governed by Belgian law. In the event of a disagreement, write to us first at contact@pointly.be: we will look for an amicable solution. Failing that, the courts of the judicial district of the publisher's domicile have jurisdiction.
